Wichtig… Abschlußprüfung ohne Betrieb beenden!

Hi Leute,

habe ein dringendes Probelm:

Ich bin im 3. Lehrjahr und habe im Mai meine Abschlussprüfung zur Inforamtikkauffrau.

Mein Problem ist, dass ich von meinem Betrieb fristlos entlassen wurde.

Weiß jemand wie ich nun vorgehen kann? Kann ich die Ausbildung ohne Betrieb beenden? Welche Möglichkeiten habe ich jetzt?

Für eure Hilfe wäre ich sehr dankbar…

Noch eine Frage: Was hast Du denn schlimmes angestellt, dass Du fristlos entlassen wurdest???

Da gibt’s aber normalerweise erst ‚mal eine Abmahnung. Bei Festangestellten und erst recht bei Azubis!

bist Du Dir da sicher? Bei einem Azubi???
Es muss etwas Gravierendes vorgefallen sein. Dazu zählen IMHO:

• Diebstahl
• Gewaltanwendung
• glaubwürdiger Drohung
• schwerwiegender Beleidigung
• beharrlicher Arbeitsverweigerung

Unentschuldigtes Fehlen würde ich nicht dazu zählen. Zumindest würde ich eine Kündigung so kurz vor dem Ausbildungsende anfechten (wenn es sinnvoll erscheint)!

Habe dazu im Internet auch gefunden:
„Gefestigte Rechtsprechung ist aber auch, dass kleinere Verfehlungen, wie häufiges
Zuspätkommen, unentschuldigtes Fernbleiben oder Überschreiten des Urlaubs für sich allein
noch nicht zur fristlosen Kündigung berechtigen.“

Laut „unserem“ Arbeitsrechtsanwalt ist unentschuldigtes Fehlen gleichzusetzen mit Diebstahl – ein nicht wieder gut zu machender Vertrauensbruch, der zur fristlosen Kündigung berechtigt.

Zudem ist der „Vorbildcharakter“ zu beachten, d.h. wenn einer damit durchkommt, berechtigt das die anderen quasi auch dazu.

Allerdings mahnen wir auch zunächst ab – aber nur einmal, dann ist Schluss mit lustig.
